The sooner a motor vehicle injury claim is lodged, the better. Strict time limits apply, particularly if the vehicle at fault is unregistered or unidentified.
If the at-fault vehicle is registered and identified, a claim should be lodged within 9 months of the date of the accident or within 1 month of consulting a lawyer, whichever occurs first.
If we are unable to resolve your claim with the insurer, then legal proceedings must be started – this must take place within 3 years of your injury.
If the at-fault vehicle is unregistered or unidentified, a claim should be lodged within 3 months of the date of the accident or within 1 month of first consulting a lawyer, whichever comes first. If a claim is not lodged with the Nominal Defendant within 9 months of the date of the accident, any claim against the Nominal Defendant is extinguished.
