Statement about the operation of the law of negligence and a person’s rights under the law

Queensland law recognises the right of an individual to recover damages (compensation) where that individual suffers personal injury and “consequential loss” (including wage loss or potential future wage loss) as a result of the fault of another. “Consequential loss” can include:

• Wage loss up to the date of settlement or judgment;
• Future wage loss or impairment of earning capacity;
• Out of pocket expenditure on medications and medical treatments.

If you have contributed to the cause of your injuries you may still be entitled to recover compensation.

Strict time limits do apply to claims and a failure to comply with those time limits will (except in rare cases) prevent you from recovering compensation for your injuries.

The conditions under which we are prepared to act in personal injury cases

If we accept your case you will only need to pay our professional fee if there is a judgment or settlement in your favour. If your claim does not succeed, you will not have to pay anything to us, although you may be liable to payment of the other side’s fees and costs.

We can also provide a funding facility for the expenses incurred in bringing your claim such as filing fees and specialists' reports. If you elect to use the funding facility, those amounts need only be repaid at the successful conclusion of your claim.
